Welcome to All Together Now. By using our service, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using All Together Now ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

All Together Now is a collaborative audio platform that allows users to:

  • Create audio recording projects (private or public)
  • Invite participants to contribute recordings via email or shareable links
  • Accept public contributions to released public messages
  • Automatically mix multiple audio recordings together
  • Schedule message releases for future dates
  • Share and deliver the final audio message
  • Browse and discover public messages created by the community

The Service is provided on an "as is" and "as available" basis.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized account use

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Content

4.1 Your Content

You retain ownership of any audio recordings, text, images, or other content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for the purpose of providing the Service.

4.2 Content Guidelines

You agree not to submit content that:

  • Infringes on intellectual property rights of others
  • Contains illegal, harmful, threatening, abusive, or harassing material
  • Contains hate speech or discriminatory content
  • Contains explicit sexual content or pornography
  • Promotes violence or illegal activities
  • Contains malware, viruses, or harmful code
  • Violates the privacy rights of others
  • Is false, misleading, or deceptive

We reserve the right to remove any content that violates these guidelines without notice.

4.3 Participant Consent

As an organizer, you are responsible for obtaining appropriate consent from all participants before including them in a project. By inviting participants, you represent that you have a legitimate reason to contact them and that you will use their recordings only for the stated purpose of the project.

4.4 Public Messages

If you create a public message, you understand that:

  • The message and all associated recordings will be publicly accessible
  • Anyone can add their voice to public released messages
  • Public messages may appear in our gallery and search results
  • Other users can like and share public messages
  • You remain responsible for moderating content submitted to your public projects

5. Subscriptions and Payments

5.1 Free and Paid Plans

The Service offers both free and paid subscription plans. Free plans have certain limitations (projects, participants, recording duration). Paid plans ("Pro") offer additional features as described on our pricing page, including:

  • Unlimited projects and participants
  • Extended recording duration
  • Audio enhancement features (denoise, voice enhance, fades)
  • No advertisements
  • Priority support

5.2 Billing

Paid subscriptions are billed in advance on a monthly or yearly basis depending on the plan selected. Lifetime purchases are one-time payments. One-time project purchases apply Pro features to a single project. All payments are processed securely through Stripe.

5.3 Automatic Renewal

Monthly and yearly subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or the Stripe billing portal.

5.4 Refunds

We offer refunds within 14 days of purchase for monthly and yearly subscriptions, and within 30 days for lifetime purchases, provided you have not substantially used the Service during that period. One-time project purchases are non-refundable once the project has been created.

5.5 Price Changes

We reserve the right to change our prices. Price changes will not affect current subscription periods but will apply to renewals. Lifetime purchases are not affected by price changes.

6. Intellectual Property

The Service, including its design, features, functionality, and underlying technology, is owned by All Together Now and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service
  • Circumvent any access restrictions or usage limits
  • Impersonate any person or entity
  • Use the Service to send spam or unsolicited messages
  • Resell or redistribute the Service without authorization

9. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and all associated data
  • Any remaining subscription period will not be refunded except as required by law

You may delete your account at any time through your account settings.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALL TOGETHER NOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless All Together Now and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and All Together Now regarding the Service and supersede all prior agreements and understandings.
